How West Virginia alimony works

Purely discretionary — no formula Key factors: Length of marriage, time spouses lived together, present employment income and other earnings for each spouse, income-earning abilities of each spouse, property distribution during divorce, ages and mental/physical/emotional condition of each spouse, educational qualifications of each spouse, whether either spouse postponed economic/education/employment opportunities during marriage, marital standard of living, likelihood of increasing income-earning abilities, financial or other contribution to spouse’s education/training/career, anticipated expense of obtaining education and training, cost of education for minor children, costs of providing health care, tax consequences, difficulty for supported spouse to work as custodial parent, financial needs of each spouse, legal obligations to support any other person, costs and care associated with child’s disabilities, any other factors the court determines necessary Duration: Temporary support terminates upon final divorce. Rehabilitative support is for a limited period to allow financial independence. Permanent support is for spouses unable to become financially independent due to circumstances out of their control. Spousal support in gross is a set amount paid in lump sum or installments. Duration is largely discretionary.
