How Utah alimony works

Purely discretionary — no formula. However, practitioners and mediators commonly use informal guidelines estimating alimony at 30-35% of the income difference between spouses, reduced to 25% when child support is also paid. Key factors: Standard of living during the marriage, financial condition and needs of the recipient, recipient's earning capacity, paying spouse's ability to provide support, length of the marriage, whether recipient has custody of minor children, whether recipient worked in a business owned by the other spouse, whether recipient contributed to increase other spouse's skill/education, fault of either party in the marriage breakdown Duration: Alimony generally cannot be ordered for a period longer than the length of the marriage. This includes temporary alimony. Courts may extend alimony beyond the marriage length only upon finding extenuating circumstances before the termination date.
