Purely discretionary — no formula. Court-ordered spousal maintenance cannot exceed the lesser of $5,000 per month or 20% of the paying spouse's average monthly gross income. Key factors: Financial resources of each party, education and employment skills of spouses, time needed for education/training, availability of training, duration of marriage, spouse's health and age, how spouses treated each other, diligent search for employment/training/education by obligee Duration: Up to 5 years for marriages of 10-20 years or if family violence occurred; Up to 7 years for marriages of 20-30 years; Up to 10 years for marriages of 30+ years. May be longer if obligee is disabled or caring for a disabled child.
