Purely discretionary — no formula Key factors: Age of parties, earning ability of each party, duration of marriage, conduct of parties during marriage, station in life of each party, circumstances and necessities of each party, health and physical condition of each party, financial circumstances of the parties as shown by the property owned at the time of the divorce, value of the property at the time of the divorce, income-producing capacity of the property, whether the property was acquired before or after the marriage Duration: Presumptive maximum duration based on marriage length: Less than 5 years (Up to 50% of marriage length), 5-10 years (Up to 60% of marriage length), 10-15 years (Up to 70% of marriage length), 15-20 years (Up to 80% of marriage length), 20+ years (Duration agreed upon by parties or determined by court). Permanent spousal support has been eliminated.
