How Delaware alimony works

Purely discretionary — no formula. Judges balance need and ability to pay, considering various factors. Key factors: Financial resources of the requesting spouse (including marital and separate property), time and expense for education/training for the recipient, standard of living during marriage, age, physical and emotional condition of both parties, length of the marriage, contributions of either spouse to the other's education/career, paying spouse's ability to remain financially stable, tax consequences of alimony, whether either spouse postponed economic/education/employment opportunities, any other factor the court finds just and appropriate Duration: For marriages less than 20 years, alimony cannot exceed 50% of the length of the marriage. For marriages 20 years or longer, there is no limit to how long alimony can be received, and permanent alimony may be awarded in cases where the recipient spouse is unable to become self-supporting.
