How Alabama alimony works

Purely discretionary — no formula. While a rough general principle of one year of alimony for every three years of marriage may be considered, it is not a rigid formula. Key factors: Length of marriage, standard of living during marriage, age and health of each spouse, financial need of one spouse, ability to pay by the other, earning capacity, work experience, education, contributions to the marriage Duration: Rehabilitative alimony is for a limited duration, not to exceed five years, absent extraordinary circumstances. Permanent alimony is typically reserved for marriages of significant duration, such as 20 or more years. Otherwise, duration is discretionary.
